Seminole Gaming – Sports Betting Offer Terms and Conditions

Section 1. Introduction

1.1

The terms contained in this document (Sports Betting Offer Terms) apply to all Sports Betting Offer mechanics available through Seminole Gaming Platforms (each a Sports Betting Offer or Offer). These Sports Betting Offer Terms together with any applicable Specific Offer terms (Specific Offer Terms), the Terms and Conditions of Use, Loyalty Program Terms and Conditions, and Privacy Policy (collectively “the Rules”), form a legal agreement between the Patron and Seminole Gaming and can be amended only with Seminole Gaming’s written consent. By participating in any Sports Betting Offer, the Patron accepts and agrees to the Rules.

1.2

Patrons should check these Sports Betting Offer Terms and any applicable Specific Offer Terms before participating in any Sports Betting Offer.

1.3

In the event of any conflict or inconsistency between these Sports Betting Offer Terms, any applicable Specific Offer Terms, and the Terms and Conditions of Use, the Specific Offer Terms shall prevail, followed by these Sports Betting Offer Terms, but only to the extent necessary to resolve such conflict or inconsistency.

1.4

Any use of each Platform and any services available through that Platform are subject to the Rules.

Section 2. Sports Betting Offers and Offer Periods

2.1

Sports Betting Offers by Seminole Gaming may take the form of bonus offers (whether real money bonuses or some other form of incentive), competitions, contests, leagues, tournaments, other forms of Sports Betting Offer, or any combination thereof. The form of Sports Betting Offer will be described in communications issued to Patrons by Seminole Gaming (each a Sports Betting Offer Communication) or on the individual web landing page for the relevant Offer.  Unlike promotions, Sports Betting Offers require a purchase or other form of consideration by the Patron.

2.2

The period during which each Sports Betting Offer will run (Offer Period) will be specified in the applicable Specific Offer Terms. Each Offer will automatically close at the end of the relevant Offer Period, at which point no further participation in that Offer will be available. Where no Offer Period is specified, the relevant Offer will end when it is discontinued on the Platform.

Section 3. Sports Betting Offer Communications

3.1

Seminole Gaming reserves the right to limit participation in any Offer to one per person, family, household, address, or organization to whom Seminole Gaming sends the Sports Betting Offer Communication. Seminole Gaming reserves the right to restrict participation in certain Offers to Patrons who fulfill specific selection criteria. Where a Sports Betting Offer Communication permits multiple participants, Seminole Gaming reserves the right to limit the number of participants at its own discretion.

3.2

Unless otherwise indicated in the Sports Betting Offer Communication, it is intended for the addressed recipient or category of recipient only and cannot be transferred. If a Patron is not the intended recipient or within the intended category of recipient, then the offer is null and void.

Section 4. Eligibility to participate in Sports Betting Offers

4.1

To be eligible to participate in any Sports Betting Offer, Patrons must:

  • be twenty-one (21) years of age or older;
  • be physically located in Florida at the time of participation;
  • be legally entitled to use Seminole Gaming services in accordance with its Terms and Conditions of Use;
  • subject to section 5.2 below, have successfully completed registration on the Platform for the relevant service and opened a real money Patron account (Account) in accordance with the Terms and Conditions of Use;
  • satisfy any other eligibility criteria set out in the relevant sections of these Sports Betting Offer Terms in respect of certain general categories of Offer and in the applicable Specific Offer Terms; and
  • not be a Restricted Patron (as defined in Section 6) (a Qualifying Patron).

4.2

Sign-Up Offers:

Seminole Gaming reserves the right to deny participation in any Sign-Up Offer to any Patron who previously made a deposit into an Account on any Seminole Gaming Platform. Such Offers may not be used in conjunction with any other Sports Betting Offer unless specified in the Specific Offer Terms.

4.3

The identity of each participant in a Sports Betting Offer will be determined from all or any combination of the following: name, address, email address, credit/debit card number, IP address, and other forms of identification which may be required. Seminole Gaming reserves the right to request further information from any Patron if the Patron wishes to participate in certain Offers.

Section 5. Participation in Sports Betting Offers

5.1

Participation in any Sports Betting Offer is voluntary.

5.2

To participate in a Sports Betting Offer, a Patron should follow the instructions set out in the relevant Sports Betting Offer Communication on the individual web landing page for that Offer and any applicable Specific Offer Terms. Patron

5.3

Entry into each Offer may be used only once unless otherwise indicated in the applicable Specific Offer Terms.

Section 6. Restricted Patrons

“Restricted Patron” means any person who is prohibited pursuant to § 17 of the Seminole Tribal Gaming Commission Sports Betting Regulations. Seminole Gaming will not accept wagers from (1) Any Covered Game Employee of the Seminole Tribe’s Sports Betting operation as defined under the 2021 Gaming Compact between the Seminole Tribe of Florida and the State of Florida (“the Compact”); (2) Any person whose identity is known to the Tribe and whose name appears on any exclusion or self-exclusion list; (3) Any person who is a Restricted Patron as defined under the Compact; (4) Any person who has access to nonpublic confidential information held by the Seminole Tribe or a Qualified Parimutuel Permitholder; (5) Any person who is an agent or proxy for any other person and is wagering for such other person; or (6) Any person who is excluded from wagering for any other good cause.

Section 7. Qualifying Deposits

A Patron must make any specified minimum required deposit into its Account (a Qualifying Deposit) to participate in any Offer unless otherwise stated in the Specific Offer Terms.

Section 8. Release and withdrawal restrictions

8.1

In relation to some Offers, certain release requirements or withdrawal restrictions must be satisfied in addition to the general eligibility criteria set out in these Sports Betting Offer Terms before a bonus may be used, played, or withdrawn. Specific Offer Terms may include other restrictions and requirements.

8.2

If a Patron attempts to withdraw funds that it had received as a bonus without having met any applicable release requirements, withdrawal restrictions, or general eligibility criteria, the Patron shall forfeit the entire sum of the bonus and any winnings resulting from the bonus, and Seminole Gaming shall be entitled to deduct the bonus amount from that Patron’s Account.

Section 9. Payment of bonuses

9.1

Subject to Section 8.1, all bonuses will be paid into the Accounts of Qualifying Patrons within seven (7) days of entry into the relevant Offer.

9.2

Any Patron’s use of bonuses is subject to Seminole Gaming review for irregular or unusual playing patterns. To ensure fair gaming and the proper use of bonuses, Seminole Gaming considers low margin betting, equal betting, zero risk bets or hedge betting to be irregular gaming when deployed to exploit bonuses. Further examples of irregular playing patterns also include, but are not limited to: (i) placing single or multiple bets of a value of fifty percent or more of the bonus on any single game or round, building a balance and significantly changing play patterns (bet size, game types, bet structures etc.) in order to meet the bonus release requirement; (ii) placing large bets which result in a substantial gain followed by a drop in bet size equal to or more than seventy five percent of the previous average bet size until the bonus release requirements have been met; or (iii) if Seminole Gaming has sufficient grounds to suspect that a Patron has sought only to exploit a bonus offered by Seminole Gaming in good faith to enhance Patron entertainment (for example, on acceptance of a bonus, the minimum wagering requirement is met and funds are subsequently withdrawn). If Seminole Gaming deems that an irregular playing pattern has taken place, Seminole Gaming reserves the right to prevent any Patron from cashing out Account funds and/or withhold any winnings derived from use of the bonus.

9.3

Seminole Gaming reserves the right to seek the return of the amount of any additional bonus or payment from that Patron’s Account if more than one bonus or any excess payment is erroneously paid to a Qualifying Patron.

Section 10. Prizes

10.1

Qualifying Patrons who win a prize as the result of any Sports Betting Offer consisting of a competition, contest, league, or tournament (each, respectively, a Winner and a Prize) must accept the relevant Prize “as is” and there is no right to a cash alternative unless Seminole Gaming elects to offer such a cash alternative. Seminole Gaming reserves the right, at any time, to substitute any Prize with one or more Prizes of similar value.

10.2

No favoritism will be shown by Seminole Gaming in terms of gender, age, geographic location, length of time as a Qualifying Patron, which gaming channels or Platforms a Qualifying Patron has used, or any other factor.

10.3

Seminole Gaming controls the method of delivery or collection specified for each Offer.

10.4

Any transactions (e.g., chargeback fees, non-sufficient funds, etc.) that cause a Patron’s account credit balance to be negative must be paid to Seminole Gaming before any individual cash Prize is issued to the Patron. Seminole Gaming reserves the right to withhold any cash Prize that any Patron wins to cover that Patron’s negative account credit balance. Seminole Gaming also reserves the right to withhold any non-cash Prize the Patron wins until that Patron’s account credit balance is zero or greater. A Patron’s account credit balance must be zero or greater within 30 calendar days of that Patron being notified of its non-cash Prize win or such Prize may be forfeited. Seminole Gaming reserves the right to not award a Prize or to seek the return of any Prize awarded if the Winner is not entitled to receive such Prize under any applicable law or if Seminole Gaming has cause to disqualify the Winner in accordance with Section 6 or any other provision in the Rules.

10.5

If a Patron is competing in a contest, league, or tournament and is unable or chooses not to progress to the next round after qualifying to do so, that Patron will forfeit its place and will not be eligible to receive any Prize to be awarded subsequently.

10.6

Any privilege to receive a Prize is non-transferable.

10.7

The Winner is solely responsible for the payment of any applicable tax in relation to the relevant Prize and for any costs associated with the Prize or its use.

10.8

Where a Prize consists of an event, activity, holiday, or the performance of a service, the Winner is solely responsible for complying with any booking, other conditions, or instructions from the relevant third-party provider or organizer and the Winner must comply with any restrictions as to dates and times in relation to the Prize. Any contract in relation to any such event, activity, holiday, or service will be directly between the Winner and the relevant third-party and Seminole Gaming will not be a party to that contract or incur any liability. Seminole Gaming will not provide any form of insurance for any Prize consisting of an event, activity, holiday, or service.

10.9

Any use of a third-party name or trademark is proprietary to the relevant third party. No license, affiliation, sponsorship, or endorsement is claimed or should be inferred from the use of these names or trademarks or the use of any photograph of a Prize. Any photograph used to promote a Prize is for illustrative purposes only and the actual Prize may differ from the item shown in the photograph.

10.10

Seminole Gaming’s offering of a particular Prize implies no affiliation, sponsorship, or endorsement of the relevant third-party manufacturer, supplier, provider, or organizer.

Section 11. Publicity and intellectual property

11.1

Patrons agree to cooperate in all advertising and marketing activities arranged by Seminole Gaming by participating in any Sports Betting Offer in which a Patron may win a Prize or which takes the form of a contest, league, or tournament. Patrons also agree to (a) wear any branded clothing or attire Seminole Gaming may provide; and (b) sign an irrevocable release form allowing Seminole Gaming to use any Patron’s name, photograph, likeness, details of the country and city where that Patron resides, any comments attributed to that Patron, and to incorporate any such information and any audio/visual recording or broadcast for promotional purposes.

11.2

Patrons participating in Seminole Gaming hosted Offer events agree not to make use of any third-party branding or advertising for any organization that Seminole Gaming deems to be its competitor. Seminole Gaming reserves the right not to award a Prize or to seek the return of any Prize awarded in the event of a breach.

11.3

Patrons warrant that any submission or entry made when participating in a Sports Betting Offer is the original work of that Patron and will not infringe on the intellectual property rights of any other person. Patrons also agree to assign all rights in such material to Seminole Gaming to allow Seminole Gaming to use such material as it pleases.

Section 12. Currency

All references to sums of money will be in U.S. currency.

Section 13. Seminole Gaming liability

Seminole Gaming shall incur no liability if any Sports Betting Offer cannot be executed as planned due to any technical problems or circumstances beyond its control.

Section 14. Alteration and termination of Sports Betting Offers; modification of the Rules

14.1

Seminole Gaming reserves the right to alter, discontinue, or terminate any Offer, or any aspect of an Offer, for any reason.

14.2

Seminole Gaming may modify any Rules at any time by posting the modified terms on the relevant page(s) of the Platform. Seminole Gaming recommends that Patrons revisit these Sports Betting Offer Terms regularly. Patrons accept any such modified terms by continuing participation in any Offer.

Section 15. General

15.1

Patrons may not assign or transfer any rights or obligations under the Rules.

15.2

No third party shall have a right to enforce the Rules.

15.3

Failure to enforce a right under the Rules does not result in waiver of such right.

15.4

Any part of the Rules found to be unenforceable as a matter of law shall not affect any other parts of the Rules which will remain in full force and effect.

15.5

Any dispute or situation not specified in the Rules will be resolved by Seminole Gaming management in accordance with the Seminole Tribal Gaming Code, with appeals to the State Compliance Agency.

15.6

If any Rules are translated into a language other than English, the English version shall prevail where there is any inconsistency. If you have any questions, please contact our Customer Service team.
